炒工人 - 急 !!

菲律賓工人做左差不多兩個月，現決定與她終止合約，想問除左要俾多一個月糧及單程機票外，尚有什麼地方要注意的??

- 你要留意佢落機後,要唔要轉內陸機,或車,先可以番到屋企,因為你要包佢到屋企,車費幾十呅搞掂
- $100 - food & travelling allowance(refer to yr employment contract no. 7b)
- NO annual leave as she has not worked over 3 mths

Did you hire her thru an Agency. If yes, ask agent to handle for you. But you still need to work a little make sure the Agency will not miss every single part.

This is what I did two months ago when I fired my ex-helper:

Handle by Agency:
One way airticket
Hong Kong travel Allowance $100
Philippines travel allowance from $100 to $300 depends on how many days it will takes her to travel back home from Manila Airport
Unpaid salary

DO FORGET to do the following in front of the Security guard or one of your friend :
Check her baggage, ask her to empty all pockets on the cloths that she is wearing before she leave her home.

Ask her to acknowledge the termination letter, you must keep the original.

Reference letter - no need

Ask her to sign a letter; witnessed by the security guard or your friend say that she is in very good shapes and has noting left in your home at the time she leave, also put down the time.

This is what I could think of for the time being. Maybe someone else could add more important points.

如果我於本星期六下午通知工人終止合約，機票是否應買該日的? 因為該天的最後一班機是 9:00pm，須然機票有效日期為14天，但她於該天應沒有足夠時間通知航空公司轉日期，但如果我買星期日或下星期的任何一日，她會否追討留港期間的住宿費??

By law, she has the right to stay in Hong Kong for 14 days, therefore, to play safe give her a ticket on the last day, i.e. if you fire her on the 1st give her a ticket on the 14th? (you better call up Immigration to double confirm).

Just in case, I mean just in case... I issued a one year open ticket for my ex-helper because I knew she will file a claim with Labour Department. As long as you are sure that she is not going to play any tricks or file a claim with Labour Department, you could give her a ticket (14 days counting forward from the date of termination), otherwise you will have to responsible for issuing another ticket for her.

Once the contract is terminated meaning the relationship between you and herself is ceased, she cannot 追討留港期間的住宿費??

不好意思，剛剛發了一個 Post 給妳才見到妳於這裡已作出回應...
跟開我的 Agent 的同事話機票買下星期都沒有問題，但佢又話要計大假給工人，我都唔知聽邊個好？

至於機票問題，佢地俾唔到正面回應我；只係話14日機票就 ok，我問如果買下星期一有冇問題，工人會唔會要我計番留港食宿俾佢，佢話佢地冇咁既條例，要我自己同工人傾 (我要即時炒佢要佢走...補機票在同一日，點傾啫?? 我要提早買機票架嘛；唔通傾完第二日先補俾佢咩??)

你不可以買下星期一的機票給她，除非你有本事　”ａｉｒｔ”　她上機，否則她有權要求你給她another airticket that allows her to stay another 14 days in Hong Kong.

工人會唔會要我計番留港食宿俾佢．佢話佢地冇咁既條例，要我自己同工人傾．．．(跟本没有需要，不用自尋煩惱，不提也吧，如工人想同你計，你可以 tell her this item is not stated in the contract, also under the laws of Hong Kong you are not responsible for this item. 我炒人無數，未有人ｃｌａｉｍ　我ｄ個ｉｔｅｍ．

for the ticket, u can buy a open ticket which can change the date. For my personal experience,e.g. when I fire the maid on 01/08, I buy the ticket with the date before 14/08 (any date, e.g. 07/08), provide that she can change the boarding date by herself if she is not satisfied. I buy ticket in Hong Tai travel, they said that they will charge the maid $100 if she needs to change the date.(no need u to pay).

After u fired her and faxed the letter to immigration, she has no right to charge u any eating and living costing wor!

The above is my personal experience, if there is some concept wrong, pls comment!!

有朋友話不用買機票，要求旅行社給有關機票的報價單，然後付相等的金額給工人代替機票... 不知可行否?? 有沒有聽講過呀 ??

if u issue the ticket at 07/08, she can change the date if she want early to leave, e.g. 01-06/Aug , but need to pay $ to change the date (just like delay the date after 07 Aug. )
Someone said that if u believe the agent, u can give $ to the agency and asked them to buy for u. but I did not believe them, so I will buy by myself and ask the maid the sign on the ticket copy!

For my first fired maid, I fired her on Sun, and buy the ticket with boarding date on Tue. (of course she can change the boarding date later lar) At the end, she left on Tue!
